Does this look like a new battery?

I need some help here. I bought and paid for a brand new battery and what I received does not look like a brand new battery. I did send an email out to the dealer regarding this but I wanted a second opinion. So, would you guys please suggest if this really looks like a brand new battery by looking at the pictures?

Is there a way to check how many times a battery pack has been charged?

By the way this is a Bosch Power Pack 400 battery for the HaiBike Xduro line of bikes.

That lettering is likely 'distressed look'. I believe it's supposed to look like you ride your mtb hard. Kind of like people paying $80 for worn and ripped jeans.

At the first photo the zero is distressed, and if I look carefully, I se some more damage. Could be new but damaged, could be used....

The graphics on the sides are designed that way. There's clearly some scratching of the "Powerpack" sticker on top, but that probably occured while being packed and shipped. I've quickly learned after a few weeks of Haibike ownership that the battery graphics are almost comically easy to mess up when removing/reinstalling. It's a neat design element to extend the frame's graphics to the battery for a cohesive look, but in reality they don't adhere to the battery like they do the frame tubes.

The quickest way to know if this is a brand new battery is to take it to Gregg's cycles and have them run a diagnostic test on the bike. The software will show all the parameters (# of cycles, current Ah capacity, temperature etc).
If the # is cycles is more than 5, Call San Diego Fly rides and ask them what's going on.

To close the loop on this, the dealer confirmed that it is a new battery but was removed from another bike due to upgrading to a 500 Watt battery. The scratches came from storage and he confirmed it has a max of 3 cycles charge. So all is good.

Hmm, "3 cycles" and "removed from another bike" is not a brand new battery. It's obviously new enough to shrug your shoulders and live with it, but I hope you got, like, $50 off the price. When I pay for "brand new", I don't mean "except for it was ridden a bit and pulled a few times for a recharge and oh yeah we scratched the stickers a bit."
