Good question, which raises another.
Do you need a drivers license to own and ride in an autonomous vehicle of any kind?
I think there are two related questions:

1. Could an autonomous vehicle be allowed to drive around without any human in the vehicle at all?
2. Could someone who was intoxicated be in an autonomous vehicle and not get a DWI?

I imagine it is going to take many years to work all that out. Working that out will (in many ways) be more complex and ugly than getting autonomous vehicles to work reliably enough (which they still don't) in the first place. At this point in time all known autonomous vehicles still have scary failure modes that require human intervention with very rapid reaction times.

One Fall morning I hear bad noises as a car tried to start. Then shocking screams of Horror! It was Halloween morning. The owner's cat had climbed up into the engine compartment with all the belts to absorb the warmth.
Turkeys like to land on cars and surf down on their claws, again and again, it is fun. Soon, on October 12th they will get their payback in Canada!
we had a cat like that once, lost front paw in a leg hold trap and his tail fell victim to a v belt( it was really gross when he would rub against you with that skeletonized tail bone, finally a poleax amputated the remnants (a little spurt of blood and "yowel" he was back home in a few hours, that surgery must have hurt less then the dead tail!(so it goes)
