daymak throttle not working/brake engaged?

hi all...bought a used daymak for my fatherinlaw. I test road it and everything was working great. to ship it home I took the side view mirrors off so it would fit in my van. when I got home I tried to ride it and the throttle isn't working and it seems as though the rear brake is engaged. when I turn on the bike with the key the brake light comes on and the rear wheel is hard to spin. I'm thinking the brake is stuck...anyone have this issue before? any input would be great. thanks in advance.

the light is activated on a switch, the brake is mechanical. Does it have a lock on the rear wheel, usually built into the hub on the brake drum.
