I wonder if a speed pedelec on a bike path going 20 mph would be cited, since the article states that only type 1 & 2 e-bikes are legally allowed.

They could be cited, but there is absolutely no enforcement of these provisions currently. If you take an S-pedelec and put a '32km/h max' sticker on the motor, you'd probably be fine as long as you put your bike into a 20MPH mode if a law enforcement officer stopped you. On my IZIP E3 Dash, the throttle-only mode won't provide any assist above 20mph, so it complies with CA laws (depending on your interpretation).
