Just another update, I ran it over to my local shop and explained. They checked the bike and saw that it indeed had the wrong update on it. They corrected it and the bike rides exactly how I'd expect it to. Thanks everyone for the help

I think the same thing happened to me after my motor was replaced on warranty. I took it back for the firmware update and all was good.

Yep, during the firmware update process they ensure that you check to make sure the correct speed setting is applied. I can make my Vado 5.0 a "class 1" and make a Como 2.0 a "class 3" with the click of a button. The latter being a big no-no mind you and as previously mentioned is a great way to no longer be a valid Spec. dealer.

Also, Vado 4.0 were all class 3, 28mph pedal assist.

My 4.0 came with a loose Class 1 sticker in with the other papers and I've toyed with the idea of putting it on the bike in case I run into a class enforcement situation. The trouble is, if I were caught, I'd have no excuses ("Sorry, it was on there when I bought it!").

Just to keep the thread info accurate, the thread you're referring to was for a guy who went in for a firmware update only to buy another Como for his wife, hence the title. That isn't to say one might be charged for firmware updates, that's up to a particular shop's discretion.
