The New Juiced HyperScrambler looks like a cool, fun hi-tech electric scooter. My problem is Juiced is marketing the HyperScrambler as an e-bike. This is not an e-bike. Yes it has pedals and 7 or 9 gears, but the pedals appear to be a platform for standing or a footrest while running through the 'rough'...

This is a e-scooter and I'm genuinely concerned that products of this type, will continue to muddy the e-bike rules, where 'real' e-bikes can and more importantly where they cannot be ridden.....The top speed is 34 mph... Note the e-bike class reference, " capable of 28 mph (Class 3) performance and beyond. "

To be clear, my objection is not with the product, but rather calling it an e-bike or trying to when it is a scooter.
