Himiway Explorer pedal Assist Problem

I have a Himiway Fatboy Explorer. I purchased in April. I have a problem with the pedal assist. It will work fine then just start pulsing, turning on and off as I am trying to gain or maintain speed. The all electric throttle works fine. It does not do this all the time, it comes and goes. The charge on the battery does not matter and I can not seem to find any common occurrence for when this happens. I've taken it back to the shop, but they can not duplicate it. They believed it was in the programming, but I've tried different setups, always the same thing.

How fast are you going when this happens?

It happens at different speeds. I have the bike set for 7 assist levels. When it starts to do it, at very random times it does not seem t matter how fast I am going. Of course at the higher speeds or assist levels it is much more evident.
