I've watched some of these and some others, and, not saying everyone actually does it, but at least some of the folks do it with permission from the railroads.

Very true. PA is riddled with old abandoned lines that have either been bought by groups, individuals or reverted to the county where located. Many are leased to excursion train operators. They do give permission to people for motorcar use. Many of the cars are homemade, some are restored service cars. I've seen them many times in the northeast. There are organizations across the country.
