A bike with pedal assist to 28 mph AND a throttle isn't legally a Class 3 and never was. It's not even a legal ebike in the sense below...

20mph on throttle is the max speed nationally. If your doing 28mph with motor assist your "legal" ebike does not have a throttle.

Maybe now, but that certainly wasn't the case when we bought our Velotric Breeze 1 in Carlbad, CA in 2025.

California law has always said that Class 3 ebikes can't have throttles. And I believe national class definitions say the same...
