Speed and the Law?

Ok, so the throttle will take the bike to 20mph,,class 2, but with peddle assist it will take the bike to 28 mph, so is this still considered class 2? or does it need to exceed the 20mph with throttle only to be considered class3? Just want to be sure.
How would anyone know how fast the top speed of your bike is anyway? no registration or plates are needed. I know they say class 3 for street only but who would know it's a class 3 just riding along at low speed?
Just curious since I would not know just watching someone ride by and have never seen a police officer inspecting a bike. Maybe it's different in the city?

Class 1 = assist to 20 no throttle
Class 2 = assist to 20, has throttle to 20
Class 3 = assist to 28, throttle to 20

At this point the police have more pressing matters to attend to than inspecting bicycles here in Granbury Texas. That could change in 10 Year’s if eBikes continue to gain market share, and the nanny state continues to expand.

In most states a street legal e-bike is required to have a clearly readable label that declares what class (e.g. 1, 2, or 3) the bike is.

My suspicion is that over time states will add laws that require class 3 e-bikes to have an additional prominent tag of some sort. Maybe they will all need to be painted pink :).

I think all eBikes manufactured after Jan. 1 2018 require the sticker. I'm riding 2016 eBikes.

Well I had to look up what the heck a Dongle was?? like the idea of more speed but I think it might have a detrimental effect on the warranty? they have all kind of warnings about them on line.
