Has anyone seen this ?

If so , what's your take on it ? Is there more recent legislature I'm not aware of ?

It's a consumer product safety act that defines an ebike as a consumer product and not a motor vehicle. If you're looking for what you can ride, where you can ride and how fast you can ride, that's a state issue for the most part and you should refer to your state laws for that. Federal land in the U.S. is another issue. Most off road federal land is off limits to ebikes unless its marked for motor vehicle use, then it is okay to ride. You should always check with local land managers when riding off road.

All of these issues of use can and have changed in recent years.

I bought these because I'm older now and have had open heart surgery and two back operations and have a bunch of other fun things but am not ready to roll over and quit , die is another matter ! Every summer I go to Idaho , Wyoming and Montana to fly fish . Rather than drag my Rhino along I'm going to use this on and off trails . As far as I'm concerned if it's open to a bike or horse it's open to me riding responsibly . If I get a ticket from a Park Leo I'll pay the fine, NSFS fine is $50 and wont break me . I wont be in any State Parks . Here in Arizona nobody much cares what we do . Anyways that's my story and I'm sticking to it .

I frequently ride an e-bike on federal land in several locations here in the east. The signs I encounter on trails simply state "No Motor Vehicles" Even though the feds consider e-bikes to be motor vehicles, I have yet to be cited. The Rangers I've seen either don't know it's an e-bike or don't care. Once when I was unloading in a trail parking area, a ranger stopped and asked me a few questions about the bike. I thought for sure he was going to tell me I couldn't ride but instead, he just told me to have a good day!

I'm sure this "look the other way" attitude will vary from place to place but so far, I've been pleasantly surprised.

It appears congress, the National Park Service and the National Forest Service all have different ideas on what an e-bike really is. The rules are constantly changing and very confusing. I tend to take your approach and will continue to ride responsibly on federal land until cited or told otherwise.

On the C&O (NPS) it would make little sense to enforce as it connects to the GAP (public/private) which is Class I legal now for most sections in PA. Last summer I was told the MD side of the GAP is still technically “no motor” but ignored for the same reason. A second factor is a manpower shortage.
 
This is typical of anything run by the government . I'll do what I want anyway and if I get a ticket so be it .
