E-Bike Tariff elimination ? Please say its so !

BRAIN just reported a possible retroactive exclusion from the 25% Trump China tariffs. It's a 'maybe' until further concrete details.

One company, State Bicycle Co. , who makes adult single speed bikes got an exclusion. And it appears their argument for it may have indirectly helped the cause of ebikes , as some other category codes got an exclusion too. (Motorized skate boards, and electric motorcycles)

Still some uncertainty, whether ebikes got granted the reprieve too. As of 9/20 when Brain published it.

The US Trade Representative published a list of Chinese products granted exclusions in the Federal Register on Friday. The list includes single speed adult bikes, motorized skateboards, and electric motorcycles. The electric motorcycle category apparently includes ebikes, although BRAIN has not been able to confirm that with industry experts. "

Well I'm not holding my breath here, but the admin clearly threw the 'baby out with the bathwater' when they pimped ebike OEMS with the tariffs. So at least from this person's perspective, the retroactive reprieve is long overdue.

The electric motorcycle category apparently includes ebikes, although BRAIN has not been able to confirm that with industry experts.

I don’t see how it would not include ebikes under the tariff heading 8711.00 as that is for “Motorcycles (including mopeds) and cycles fitted with an auxiliary motor” while the next code # 8712.00 is for “bicycles, not motorized”

Don't try to be logical or make any sense out of how it's administered. It's NUTS! Believe me. A total nightmare.

Completely agree, the Harmonized tariff schedule uses separate tariff numbers for electrical motors, lithium ion batteries, printed circuit boards, and bicycle parts, and without spares a complete ebike isn’t going to be serviceable.
 
Two OEM, direct to customer complete eBike sellers, tell me they have an exemption. This is from National Sales Managers.
 
Chinese bikes are still available at reasonable prices as long as you buy them from Canadians, Germans, Taiwan, etc.
 
BRAIN report the Customs & Border Protection agency has determined ebikes fall under the Electric Motorcycle category and therefore are excluded from the 25% import tariffs.

Gawd I hope no one tells trump that, he'd change it just for spite. As it stands, I'm very happy with my new German bike,(Chinese frame
Japanese components), which cost less than half what I paid for my Chinese bike.
